Bills fire Gailey after 3 straight losing seasons

ORCHARD PARK, N.Y. (AP) ? Chan Gailey didn't work out after three losing seasons, leaving the Buffalo Bills looking for their fifth head coach since 2001.

The Bills fired Gailey on Monday after he failed to deliver on his vow to transform a losing franchise into a playoff contender. Gailey's entire staff was fired, too, but the status of general manager Buddy Nix remained uncertain, and could be decided as early as Tuesday.

Bills CEO Russ Brandon returned to Buffalo on Monday night after spending the day meeting with team owner Ralph Wilson at his home outside Detroit. Nix did not make the trip, and instead stayed at the team's facility.

The Bills have made tentative plans to have a team official address the media Tuesday.

The decision to fire Gailey was announced shortly after Brandon arrived in Detroit.

Gailey's teams lost twice as many games as they won, going 16-32 over three seasons. The Bills have now posted eight straight losing seasons, and closed with a second straight 6-10 mark after beating the New York Jets 28-9 on Sunday.

"I understand this is a business," said Gailey, who had at least one year left on his contract. "We didn't get the job done."

Gailey spoke for a little over a minute. He declined to take questions, while growing emotional at one point. Among the assistants fired were assistant head coach and defensive coordinator Dave Wannstedt.

"I've been called two other times to get things turned around, was able to do it," Gailey said, referring to previous stops with Dallas (1998-99) and Georgia Tech (2002-07). "We weren't able to get this one done soon enough, and I understand that completely."

It was a disappointing finish for a team that had much higher aspirations. The Bills spent much of the past 14 months securing their top players, re-signing receiver Stevie Johnson and quarterback Ryan Fitzpatrick to lucrative multiyear contracts.

The spending spree reached its peak in March, when they signed defensive end Mario Williams to a six-year, $100 million contract.

"It's always disappointing," said defensive tackle Kyle Williams, one of the only players left in the locker room when the team announced Gailey's firing.

What frustrates Williams more is how the Bills keep making changes without getting any results.

"I get tired of losing," Williams said. "More than anything, I get tired of putting in tons and tons of work. And it's hard sitting here talking to you guys at the end of December feeling like another one kind of slipped through your fingers."

What's next remains unclear.

Nix was not available Monday, and canceled his weekly radio show on Friday.

Gailey's dismissal is a significant setback for Nix. The general manager announced in November that Gailey wasn't going anywhere, because another coaching change would stunt the team's development.

The Bills, however, closed by losing seven of their final 10 games.

Wilson had initially backed Nix's build-through-the-draft approach. Three years ago, the 94-year-old owner said he expected the rebuilding process could take as long as five years.

Brandon has been unhappy with the criticism leveled at the Bills, and how it's translated into poor ticket sales. Buffalo failed to sell out its three of its final four home games. And the fourth, against St. Louis on Dec. 9, wasn't a sellout until a local restaurateur purchased the remaining 10,000 tickets.

One option is for the Bills to make a splash in hiring their next head coach, as they attempted in their previous search.

After firing Dick Jauron in November 2009, Wilson expressed a desire to open his checkbook to lure a high-profile coach to Buffalo only to be rebuffed by Mike Shanahan, who instead landed in Washington.

The most high-profile candidates available include coach-turned-broadcaster Jon Gruden and Andy Reid, who was fired by Philadelphia on Monday. Then there's two candidates in the college ranks, Oregon's Chip Kelly and Penn State's Bill O'Brien, who had numerous friends and former colleagues on Gailey's staff.

An offensive specialist, Gailey was unable to spark the Bills popgun attack under Fitzpatrick. The Bills finished 19th in the NFL in yards gained and 21st in points this season. Gailey was faulted for under-utilizing the offense's most dynamic threat, running back C.J. Spiller.

"It's sickening," running back Fred Jackson said, referring to how the Bills failed to play up to expectations. "As players, we had the highest hopes out of everybody. And for us to fall short of that, we don't like it at all. It's depressing."

Ultimately, it was the Bills' porous defense that doomed Gailey.

The Bills allowed 400-plus points in each of the past three seasons, including 435 this year ? the second-most in team history. Though Williams' presence improved the pass rush, Buffalo became the NFL's eighth team, and first since the 1986 Jets, to allow 45 points four times in one season.

Fitzpatrick's status is uncertain in part because he's due a $3 million bonus in March. He went 16-29 since taking the starting job three games into the 2010 season.

Fitzpatrick declined to speculate on his future. After speaking to reporters, Fitzpatrick hugged Johnson, and the two left with the receiver's arm over the quarterback's shoulder.

Reading from notes he jotted on a Bills pad, Gailey's eyes welled with tears when he credited Bills fans for their loyalty, and Buffalo for being a passionate football city.

"I think that the next staff will have a great opportunity for success, and make this another great football franchise," Gailey said. "This will probably be, and I say probably, but I think it will be the first place that's ever fired me that I'll pull for."

Progress seen in last-minute 'fiscal cliff' talks

WASHINGTON (AP) ? Working against a midnight deadline, negotiators for the White House and congressional Republicans in Congress narrowed their differences Monday on legislation to avert across-the-board tax increases.

Congressional officials familiar with talks between Vice President Joe Biden and Senate Republican leader Mitch McConnell said one major remaining sticking point was whether to postpone spending cuts that are scheduled to begin on Jan 1.

Republicans want to replace across-the-board reductions with targeted cuts elsewhere in the budget, and the White House and Democrats were resisting.

At the same time, Democrats said the two sides were closing in on an agreement over taxes. They said the White House had proposed blocking an increase for most Americans, while letting rates rise for individuals with incomes of $400,000 a year and $450,000 for couples, a concession from President Barack Obama's campaign call to set the levels at $200,000 and $250,000.

Any overall deal was also likely to include a provision to prevent a spike in milk prices with the new year, extend unemployment benefits due to expire and protect doctors who treat Medicare patients from a 27 percent cut in fees.

Both the House and Senate were on track to meet on the final day of the year, although there was no expectation that a compromise could be approved by both houses by midnight, even if one were agreed to.

Instead, the hope of the White House and lawmakers was to seal an agreement, enact it and send it to Obama for his signature before taxpayers felt the impact of higher income taxes or federal agencies began issuing furloughs or taking other steps required by spending cuts.

Regardless of the fate of the negotiations, it appeared all workers would experience a cut in their-home pay with the expiration of a two-year cut in payroll taxes.

Officials who described the negotiations did so on condition of anonymity, citing the confidential nature of the discussions.

A spokesman for McConnell, Don Stewart, said the Kentucky lawmaker and Biden "continued their discussion late into the evening and will continue to work toward a solution. More information as it becomes available."

Unless an agreement is reached and approved by Congress by the start of New Year's Day, more than $500 billion in 2013 tax increases will begin to take effect and $109 billion will be carved from defense and domestic programs

Though the tax hikes and budget cuts would be felt gradually, economists warn that if allowed to fully take hold, their combined impact ? the so-called fiscal cliff ? would rekindle a recession.

"This whole thing is a national embarrassment," Sen. Bob Corker, R-Tenn., said Monday on MSNBC, adding that any solution Congress would swallow at this late stage would be inconsequential. "We still haven't moved any closer to solving our nation's problems."

In a move that was sure to irritate Republicans, Reid was planning ? absent a deal ? to force a Senate vote Monday on Obama's campaign-season proposal to continue expiring tax cuts for all but those with income exceeding $200,000 for individuals and $250,000 for couples.

In one sign of movement on Sunday, Republicans dropped a demand to slow the growth of Social Security and other benefits by changing how those payments are increased each year to allow for inflation.

Obama had offered to include that change, despite opposition by many Democrats, as part of earlier, failed bargaining with House Speaker John Boehner, R-Ohio, over a larger deficit reduction agreement. But Democrats said they would never include the new inflation formula in the smaller deal now being sought to forestall wide-ranging tax boosts and budget cuts, and Republicans relented.

"It's just acknowledging the reality," Sen. Susan Collins, R-Maine, said of the GOP decision to drop the idea.

There was still no final agreement on the income level above which decade-old income tax cuts would be allowed to expire. While Obama has long insisted on letting the top 35 percent tax rate rise to 39.6 percent on earnings over $250,000, he'd agreed to boost that level to $400,000 in his talks with Boehner. GOP senators said they wanted the figure hoisted to at least that level.

Senators said disagreements remained over taxing large inherited estates. Republicans want the tax left at its current 35 percent, with the first $5.1 million excluded, while Democrats want the rate increased to 45 percent with a smaller exclusion.

The two sides were also apart on how to keep the alternative minimum tax from raising the tax bills of nearly 30 million middle-income families and how to extend tax breaks for research by business and other activities.

Republicans were insisting that budget cuts be found to pay for some of the spending proposals Democrats were pushing.

These included proposals to erase scheduled defense and domestic cuts exceeding $200 billion over the next two years and to extend unemployment benefits. Republicans complained that in effect, Democrats would pay for that spending with the tax boosts on the wealthy.

"We can't use tax increases on anyone to pay for more spending," said Sen. Kay Bailey Hutchison, R-Texas.

Both parties also want to block an immediate 27 percent cut in reimbursements to doctors who treat Medicare patients. Republicans wanted to find savings from Obama's health care bill as well as from Medicare providers, while Democrats want to protect the health care law from cuts.

Sony Releases Beta Flash Tool for Unlocked Xperia Devices

Sony Releases Beta Flash Tool for Unlocked Xperia Devices

When you purchase a device, it?s always desirable to be able to use it as you wish. Sadly, this is often not the case. This is because most of the time, people purchase devices with a carrier subsidy. What this means is that essentially the carrier is letting you purchase the device at a reduced rate, say $300 off suggested retail, with the terms of a contract stating you will stay with them for (usually) two years. This guarantees that they will keep their ARPU (average revenue per user) over that time.

The trade off is that if you break the contract, they will charge you an ETF (early-termination fee), which adds up to the same amount they ?discounted? the phone for, prorated of course. Usually rolled in with that trade off is an agreement between the manufacturer and the carrier that the bootloader is locked, giving the carrier the full control of the device instead of you.?Of course, with the talented developers here at XDA-Developers,?bootloaders are often hacked, returning the control of the device to the user.

What often doesn?t happen though is manufacturers deciding to give you control of the device on their own, which is exactly what Sony has done with their beta flash tool they call ?Emma.? Sure Samsung ?leaked? ODIN, but that?s entirely different. This is Sony creating a tool and freely making it available, and then going the extra step to show you how to use it. The tool is for the Xperia S, Xperia Arc, Xperia Arc S, and Xperia T, with more devices to be added in the future. Emma is essentially a ?return to stock? tool that will work regardless of what software you currently have installed on your Xperia device, though it does require the bootloader be unlocked which Sony is again more than happy to show you how to do. The other requirements for the tool are that you have Windows installed and a current version of JAVA.

You can use the tool to choose between different stock versions of firmware, which the tool will automatically download for you from Sony?s servers. There are some quirky things with the tool however, with the connection to the Sony servers being?temperamental?and general JAVA issues. That said, the tool is still in beta, so head on over to the?discussion thread?to address any issues you might be having and to download the tool.

Suspects in India rape case charged with murder

NEW DELHI (AP) ? Indian police have charged six men with murder, adding to accusations that they beat and gang-raped a woman on a New Delhi bus two weeks ago in a case that shocked the country.

The murder charges were laid Saturday, hours after the woman died in a Singapore hospital, where she had been flown for treatment.

New Delhi police spokesman Rajan Bhagat said the six face the death penalty if convicted, in a case that has triggered protests across India for greater protection for women from sexual violence, and raised questions about lax attitudes by police toward sexual crimes.

The tragedy has forced India to confront the reality that sexually assaulted women are often blamed for the crime, forcing them to keep quiet and discouraging them from reporting it to authorities for fear of exposing their families to ridicule. Police often refuse to accept complaints from those who are courageous enough to report the rapes, and the rare prosecutions that reach courts drag on for years.

Indian Prime Minister Manmohan Singh said he was aware of the emotions the attack has stirred, adding it was up to all Indians to ensure that the young woman's death will not have been in vain.

The victim, who has not been identified, "passed away peacefully" early Saturday at Mount Elizabeth hospital in Singapore with her family and officials of the Indian Embassy by her side, Dr. Kevin Loh, the chief executive of the hospital, said in a statement.

The victim's body was cremated Sunday in New Delhi soon after its arrival from Singapore on board a special Air-India flight, amid an outpouring of grief by people across the country.

Singh and Sonia Gandhi, head of the ruling Congress party, were at the airport to receive the body and meet family members of the victim who had also arrived on the special flight.

After 10 days at a hospital in New Delhi, the Indian capital, the victim was brought Thursday to Mount Elizabeth, which specializes in multi-organ transplants. Loh said the woman had been in extremely critical condition since Thursday, and by late Friday her condition had taken a turn for the worse, with her vital signs deteriorating.

"Despite all efforts by a team of eight specialists in Mount Elizabeth hospital to keep her stable, her condition continued to deteriorate over these two days," Loh said.

The woman and a male friend, who also has not been identified, were on a bus in New Delhi after watching a film on the evening of Dec. 16 when they were attacked by six men who raped her. The men beat the couple and inserted an iron rod into the woman's body, resulting in severe organ damage. Both were then stripped and thrown off the bus, according to police.

As news of the victim's death reached New Delhi on Saturday, hundreds of policemen sealed off the high-security India Gate area, where the seat of India's government is located, in anticipation of more protests.

The area is home to the president's palace, the prime minister's office and key defense, external affairs and home ministries, and has been the scene of battles between protesters and police for days after the attack.

Police were allowing people to assemble at the Jantar Mantar and Ramlila grounds, the main areas allotted for protests in New Delhi, Bhagat said.

Mourners gathered at Jantar Mantar to express their grief and demand stronger protection for women and the death penalty for rape, which is now punishable by a maximum of life imprisonment. Women face daily harassment across India, ranging from catcalls on the streets, groping and touching in public transport to rape.

They put a wreath studded with white flowers on the road, lit a candle and sat around it in a silent tribute to the young woman. Members of a theater group nearby played small tambourines and sang songs urging Indian society to wake up and end discrimination against women.

Dipali, a working woman who uses one name, said the rape victim deserved justice. "I hope it never happens again to any girl," she said.

Dozens of students of Jawaharlal Nehru University in New Delhi marched silently to the bus stop from where the rape victim and her friend had boarded the bus on Dec. 16. They carried placards reading "She is not with us but her story must awaken us."

Sonia Gandhi, the governing Congress party chief, assured the protesters in a statement that the rape victim's death "deepens our determination to battle the pervasive, the shameful social attitudes and mindset that allow men to rape and molest women and girls with such an impunity."

The protesters heckled Sheila Dikshit, the top elected leader of New Delhi state, when she came to express her sympathy with them and forced her to leave the protest venue. They blamed her for the deteriorating law and order situation in the capital.

Meenakshi Ganguly, South Asia director of Human Rights Watch, said the woman's death was a sobering reminder of the widespread sexual violence in India.

"The outrage now should lead to law reform that criminalizes all forms of sexual assault, strengthens mechanisms for implementation and accountability, so that the victims are not blamed and humiliated," Ganguly said.

Prime Minister Singh said he understood the angry reaction to the attack and that he hoped all Indians would work together to make appropriate changes.

"These are perfectly understandable reactions from a young India and an India that genuinely desires change," Singh said in a statement. "It would be a true homage to her memory if we are able to channel these emotions and energies into a constructive course of action."

Mamta Sharma, head of the state-run National Commission for Women, said the "time has come for strict laws" to stop violence against women. "The society has to change its mindset to end crimes against women," she said.

Indian attitudes toward rape are so entrenched that even politicians and opinion makers have often suggested that women should not go out at night or wear clothes that might be seen as provocative.

Separately, authorities in Punjab state took action Thursday when an 18-year-old woman killed herself by drinking poison a month after she told police she was gang-raped.

State authorities suspended one police officer and fired two others on accusations they delayed investigating and taking action in the case. The three accused in the rape were arrested only on Thursday night, a month after the crime was reported.

"This is a very sensitive crime, I have taken it very seriously," said Paramjit Singh Gill, a top police officer in the city of Patiala.

The Press Trust of India reported that the woman was raped Nov. 13 and reported the attack to police Nov. 27. But police harassed the girl, asked her embarrassing questions and took no action against the accused, PTI reported, citing police sources.

Building Your Dream Home in Mexico ? Overcoming Obstacles

Whether a?Mexico real estate owner chooses to work with a professional and communicate from a distance or not (as I discussed yesterday, and Tom and Andy have discussed previously), all owners will have to consider overcoming unexpected obstacles at some point in the process of building a home in Mexico.

Building your home in MexicoObstacles

Surprises and unexpected situations are a normal part of any construction process.? They could include anything from a dog deciding to take a nap in freshly poured concrete, to the price of steel suddenly tripling, to a hurricane.

These items simply have to be dealt with and the project must move ahead.? A good construction budget should allow for a certain amount of flexibility to cover unexpected circumstances.? The same is true of the timeline.

Owners having their home built will do best to take these in stride and move ahead.? The flexibility just mentioned allows this to happen most easily.? Getting frustrated or angry will not do anything to improve the situation.

Building your home in MexicoA very important tip: have patience.? (This tip is especially useful when it comes to cultural/bureaucratic obstacles, which we will talk about in a later post.)

It also helps a good deal to have a clear goal in mind as to the final product and scope of the construction see Building Your Home in Mexico ? Part 1 ? Planning the Process & First Considerations); this helps the owner and builders to evaluate each obstacle in terms of the whole, and move ahead most appropriately.

Should a property owner decide to undertake a construction project overseeing the process himself, he will just need to be prepared for the fact that there will probably be a larger number of unexpected obstacles and should ?plan for the unplanned.?

Building your home in MexicoWhile every project will encounter unexpected obstacles, the best way to deal with these is to work with an experienced construction professional.? They will have encountered many obstacles in past projects, and will avoid the most common ones, or plan to deal with them appropriately if they are beyond anyone?s control (severe weather, market prices of materials, etc.)

Their experience will also allow them to deal with entirely new situations best.

Strong communication and planning for unexpected obstacles will be key elements in making a building project in Mexico successful.

Gophers football coach Jerry Kill defends his bowl-game decisions

Minnesota head coach Jerry Kill argues a call in the Meineke Car Care Bowl of Texas on Friday. (Kevin M. Cox/MCT)

HOUSTON -- Soon after the Meineke Car Care Bowl postgame news conference began, Gophers coach Jerry Kill had to explain himself. Why call a pass play for freshman quarterback Philip Nelson on third-and-7 with the score tied 31-31 and less than a minute left in the game?

The call certainly appeared to be a factor in Minnesota's 34-31 loss to Texas Tech on Friday, Dec. 28. Nelson was intercepted by D.J. Johnson, whose 39-yard return put the Red Raiders to win on Ryan Bustin's 28-yard field goal as time expired.

Kill, who has a history of gambling in critical situations with a fake field goal or punt, didn't want to run the clock out.

"We were in a two-minute offense and trying to win the game," Kill said. "We had a minute left on the clock, we were indoors, our kicker (Jordan Wettstein) has a chance to kick 50 yards and we were on the 35-yard line. We make two or three passes and kick a field goal and win the game."

Nelson had thrown two touchdown passes in the second half to help the Gophers retake the lead. Kill said he liked the matchup between Texas Tech's secondary and Derrick Engel, who had 108 yards receiving in the game. But the pass bounced off Engel's hands before being intercepted by Johnson.

"They made a play," Kill said. "It is just part of the game. You come to the game to win, and we had plenty of time to win the game."

Kill opened with Nelson at quarterback because the 19-year-old had started starting the previous six games. Nelson

completed 7 of 18 passes for 138 yards and two touchdowns with one interception. But the eight combined completions by Minnesota was an all-time low for the Meineke Car Care Bowl.

The Gophers had planned on using senior MarQueis Gray as both a quarterback and wide receiver, but they didn't want it to be too confusing for him. Gray finished with no catches, 59 yards rushing and one completion for 8 yards.

"We decided to play (Gray) at quarterback and (not) do things with him at receiver to let the young man focus on one situation," Kill said. "We felt like it gave us the best opportunity to win."

Imagine you're out sight-seeing in Thailand. Whoa! Elephants! Better catch some video with your iPhone. Really hold it out there for a good shot when, haha, he's touching it with his trunk! Aaaand it's gone. Sure, it'd be equal parts hilarious and a bummer if it actually happened, and while that's what this video shows, it's probably (unfortunately) bogus. More »

(AP Photo/Marcio Jose Sanchez)

(AP) ? Bare-chested Joe Staley and Mike Iupati jumped up and down wearing only their shorts, each offensive lineman doing his best to will the Vikings to victory from afar.

The 49ers ? sporting fresh red NFC West champion caps after beating the Arizona Cardinals 27-13 on Sunday ? crammed into the cozy confines of their locker room and became Minnesota's fiercest cross-country cheering section. When Blair Walsh's 29-yard field goal sailed through the uprights for the Vikings as time expired to give San Francisco a playoff bye, the tiny dressing area in Candlestick Park's south corner erupted into a crazy, celebratory scene.

"C'mon, baby, bye week!" shouted defensive tackle Ricky Jean Francois.

The Vikings certainly deserved some thanks. So did Michael Crabtree.

Crabtree's career day and dazzling catch-making display sent San Francisco to a second straight division title and into the playoffs with some much-needed momentum.

Crabtree caught touchdown passes of 49 and 7 yards and finished with a career-high 172 yards on eight receptions, leading the 49ers to another rout of Arizona after a slow start.

Colin Kaepernick threw for a career-best 276 yards and two TDs as the Niners (11-4-1) did their part to control their postseason fate ? then waited all of about 15 minutes to watch Minnesota beat Green Bay and give San Francisco the NFC's No. 2 seed and a week off before hosting a divisional playoff game.

"It was a lot harder this time around to get it," said safety Donte Whitner, his new hat on backward. "We were the target this year and got everybody's best shot. To come out and still win our division and have the opportunity to get a first-round bye is tremendous."

Frank Gore ran for a 2-yard score early in the fourth quarter for his franchise-best 51st touchdown rushing, breaking a tie with mentor Roger Craig and late Hall of Famer Joe Perry.

With yet another new face under center, the Cardinals (5-11) lost for the 11th time in their last 12 games in what might have been Ken Whisenhunt's final game as coach. Brian Hoyer went 19 of 34 for 225 yards and a late TD toss in his first NFL start as Arizona's fourth quarterback this season.

He couldn't keep up with Crabtree and Kaepernick.

Crabtree's outstanding outing was the best by a 49ers receiver since Terrell Owens' 166-yard performance on Nov. 25, 2002, against Philadelphia.

"My dude made it happen," Crabtree said, looking at Kaepernick. "I'm really focused on these playoffs."

Crabtree caught a 31-yard pass to set up his team-leading eighth TD reception on the next play. The sequence put him over 1,000 yards, giving San Francisco its first 1,000-yard receiver since T.O. in 2003.

On the next series, Crabtree made a pretty, one-handed grab with his right hand along the left sideline on third-and-11 for a 19-yard gain and first down. He made a 14-yard catch on fourth down late in the third, and later converted another fourth down with a reception of 7 yards.

What a boost for an injury-depleted receiving corps missing Mario Manningham for the rest of the season because of a knee injury. Plus, tight end Vernon Davis was limited a week after sustaining a concussion.

Struggling San Francisco kicker David Akers missed wide left on a 44-yard field goal attempt midway through the second quarter, then did it again with nearly the same kick ? from 40 yards this time ? 24 seconds before halftime. Akers put his hands on his knees and closed his eyes in frustration as boos rained down from the sellout crowd at Candlestick Park.

He missed for the fourth time in his last eight spanning three games and 13th time in 40 tries after setting an NFL single-season record with 44 field goals in 52 attempts last year. Akers bounced back by nailing one from 43 yards early in the second half but was later clipped in his kicking foot by Arizona's Justin Bethel. Akers stayed in the game, then booted a 26-yard field goal with just more than 9 minutes remaining.

Coach Jim Harbaugh didn't rule out a change.

"We'll evaluate that," he said. "It's his job to make the kicks."

Hoyer exhibited poise in the early moments. He completed seven of his first 13 passes and three straight ? for 7, 15 and 12 yards ? during one drive as Arizona took a 3-0 lead on Jay Feely's 35-yard field goal late in the first quarter. Feely added a 31-yarder early in the second to make it 6-0.

The Cardinals outgained the 49ers 129-15 in the opening quarter and held San Francisco without a first down.

But that didn't last long.

The Cardinals ended a six-game stretch without a touchdown pass when Hoyer hit Michael Floyd on a late 37-yard score. Floyd had eight catches for 166 yards.

The Cardinals pounded the ball toward the right side of San Francisco's defensive line where Pro Bowler Justin Smith had been stout against the run all season before getting hurt two weeks ago. Now, San Francisco has an extra week for Smith to heal.

"Today's game kind of mirrored our season," Whisenhunt said. "I'm proud of the way our team's worked. You understand this is part of the business. We haven't won enough games this year."

Former starting quarterback Alex Smith made what could have been his final appearance in a 49ers uniform when he entered the game with 5:57 to go ? playing to chants of "Let's Go, Alex!" and "Alex! Alex!"

Notes: Cardinals Pro Bowl CB Patrick Peterson was lost to a left hamstring injury in the fourth quarter. RG Pat McQuistan was sidelined in the first with an ankle injury and didn't return, while LB Paris Lenon injured his left hand in the second half. ... 49ers LB Aldon Smith went without a sack for the third straight game, winding up with 19? ? three shy of Michael Strahan's single-season NFL record set in 2001 for the Giants.

Tiramis? Mom: #2013Resolutions - Fitness and Health - Get Back on ...

One of my #2013Resolutions is to get back on track with yoga.

The most difficult part of yoga for me is... getting my butt to yoga class. I have no excuses: my yoga studio is literally just around the corner from our home - a three-minute walk from my front porch - and the wonderful teacher is patient, always pushes me just far enough, always reminds me to breathe.?

As usual this morning, I hemmed and hawed, looking for every excuse to not get my butt to the yoga studio. And though I did manage to get my butt over to the studio, as always, I unfurled my yoga mat down with the most unenthusiastic look upon my face and begrudgingly got into lotus pose. ? Ten minutes into the session, as usual, I felt my creaky body stretch back to where it belongs. And by the end of the hour, I felt refreshed, rejuvenated, more energetic, and less like the Tin Man I was when I entered the dimly lit room. I do hot yoga, so I feel like I've sweated out some toxins with a side of negativity. I feel my feet a bit more firmly planted into the ground, and I feel lighter.? I suppose I can consider myself a bicyclist by default, and I'm big on walking, everywhere. What I need more than anything is a lot of stretching. I want to be strong, lean, and limber. ?

So for 2013, I am going to make a point of getting my butt out the door and into yoga class, at least twice per week. I will unfurl my yoga mat with a smile knowing that in one hour, I will feel so much better.?

Health & Fitness: The Most Effective Eczema Natural Remedies ...

Many people are turning to eczema natural remedies due to their effectiveness in relieving the discomfort caused by this condition. In addition, the natural solutions are a better option when it comes to treating and preventing skin diseases and disorders from occurring in the future. Eczema is normally characterized by dryness of the skin, inflammation, a persistent itch, and reddening of the skin. If left untreated, the condition worsens rapidly.

Skin inflammation, accompanied by flaking, persistent itching and red patches is very common in patients suffering from eczema. For you to effectively deal with the condition, you must find a solution that will provide fast relief from the discomfort, as well as address the underlying causes. Corticosteroids have been in use for many years to treat these ailments. However, these drugs only offer temporary relief.

Many eczema sufferers usually visit dermatologists and other skin specialists with the hope that they will find simple, yet effective cures that they can use in the comfort of their homes. However, they may be surprised to discover that their efforts are in vain. Home treatments such as moisturizers, balanced diet, Blueberry leaf lotion, emollients, herbal baths, and Lactobacillus Acidophilus provide a simple solution for them.

Appropriate skincare is necessary if one wants to prevent this condition. For instance, ensuring that the skin is moist and supple prevents skin irritation and itching. To achieve this, one is required to use a variety of skin moisturizers such as creams and lotions on a regular basis. These products consist of high quality moisturizing regimens that will help to keep the skin healthy at all times.

A change of diet is a great way of dealing with this condition, owing to the fact that everything that one eats affects his/her overall well-being. According to recent research studies, a diet with high acidic content has a direct link to the occurrence of eczema in many patients. For this reason, health experts recommend the consumption of natural kelp supplements, whose alkaline content neutralizes the acidity.

Natural remedies containing Blueberry extracts are some of the best skincare products that you could use to treat your condition. The active ingredient in these products is the Chlorogenic acid that is found in Blueberry leaves. It contains antimicrobial agents, which are very beneficial in dealing with skin disorders. You can use the Blueberry leaf lotion to provide rapid relief from skin inflammation, swelling and itching.

Emollients are some of the best home treatments for this condition. These creams seal and moisturize the skin to prevent moisture from escaping from its layers. They have some of the greatest properties that prevent the skin from flaking and itching and in effect, make it supple and moist. Unfortunately, many people are not aware about these products, even though they can work wonders for them.

Skin conditions are known to cause low self-esteem and lower one's confidence. If left untreated, most of the skin diseases cause discomfort and discoloration, and become very hard to treat. Skincare specialists recommend the use of eczema natural remedies and products such as lavender, chamomile, oatmeal and herbal baths because they are easily accessible and can be administered in the comfort of one's home.

New Years Resolutions for your Relationship. | The Marriage and ...

New Years is a great time to look back over the previous year and make an inventory. Make an inventory of all the things you've done right so you know to keep doing them. And make an inventory of things you've done not-so-right that you'd like to improve on. This is one of the greatest things about New Years: the opportunity to let bygones be bygones and to start anew on things you wish you could.

One thing, though, that people don't often think about when they're making New Years resolutions is things they'd like to fix in their relationship with their significant other. Every relationship has its' ups and downs. This doesn't mean that it's a bad relationship. But it does mean there's room for improvement. Even if your relationship isn't under a lot of stress or if you feel your relationship is doing just fine, here are a few relationship resolutions for you to consider that will help improve your relationship. After all, what harm could a little improvement do in your relationship?

New Years Resolutions for Your Relationship

1) A little less talk and a lot more action. Every couple talks to each other about things they'd like to do more. They'd like to get tickets to the music hall or go to their favorite lake more. Forget about talking about them. Pick one or two of the easiest or most important things and actually do them. Make it a priority this year.

2) Spend more time together.?When you look back on your life, you probably won't say that you wished you spent more time at work. You'll probably say that you wished you spent more time with your loved ones. Don't risk looking back with that regret. Start this year off right and make a resolution to spend more time together.?

3) Make more memories. In a previous post about holiday gifts your lover will love I wrote about how I am a fan of giving memories for gifts instead of giving things you can buy from a store. This year, make a resolution to make more memories together. Take that vacation you always wanted or do that project on the house together. Whatever you do, make sure it makes memories.?
4) Fight less. This is one most couples want to do anyway. Every couple has one thing that they perpetually argue about: in-laws, children, money, etc. You've argued about ever since you two were together and you haven't fixed it yet. It's likely that you won't resolve it anytime soon, either. Instead of arguing about it over and over again talk with your spouse about how you can both handle the conversation next time it comes up. This will help you to fight less about it and begin the year talking about the difficulty in a positive way.

Remember, New Years resolutions are meant to point you in new directions and create new possibilities. The same can happen with your relationship. Make a resolution to focus on your relationship more this year and who knows what direction you'll be pointed in next year.?

Spain does not need European help for now, says PM

MADRID (Reuters) - Spanish Prime Minister Mariano Rajoy said on Friday that Spain did not need to tap for now the European Central Bank's bond-buying program for troubled euro zone governments but did not rule out asking for aid in the future.

Rajoy has faced pressure from Spain's international partners -- including the European Commission, the European Central Bank (ECB) and the International Monetary Fund (IMF) -- to seek a European Union bailout. He has resisted so far, helped by an easing of the euro zone debt crisis.

"We are not thinking of asking the European Central Bank to intervene and buy bonds in the secondary market," he said at a news conference in Madrid. "But we can't rule it out in the future."

Rajoy has been able to delay a rescue because the ECB's pledge to intervene in the market and support Spanish bond prices has brought down Spain's borrowing costs since the summer.

He praised the ECB's move on Friday.

"I think it has been a very significant decision. It has had a calming effect on the markets," he said.

But Rajoy's delaying tactics are risky at a time when the Spanish economy is contracting sharply, with 25 percent unemployment. Some market commentators believe Spain's finances could spiral into chaos if it is forced to seek a bailout due to a sudden deterioration in bond markets.

Spain's country risk, the premium bondholders demand to buy Spanish 10-year benchmark bonds over German benchmarks, was around 400 basis points on Friday, well off highs of above 600 in July.

Rajoy warned Spaniards of a tough year ahead, especially the first half, but said he hoped to see some improvement in the second half of 2013.

Lawyer for Newtown survivor seeks to file $100 million lawsuit

By Mary Ellen Godin, Reuters

MERIDEN, Connecticut -- A $100 million claim on behalf of a 6-year-old survivor is the first legal action to come out of the Connecticut school shooting that left 20 children and eight adults dead two weeks ago.?

The unidentified client, referred to as Jill Doe, heard "cursing, screaming, and shooting" over the school intercom when the gunman, 20-year-old Adam Lanza, opened fire, according to the claim filed by New Haven-based attorney Irv Pinsky.

"As a consequence, the ... child has sustained emotional and psychological trauma and injury, the nature and extent of which are yet to be determined," the claim said.

Pinsky said he filed a claim on Thursday with state Claims Commissioner J. Paul Vance Jr., whose office must give permission before a lawsuit can be filed against the state.

"We all know its going to happen again," Pinsky said on Friday. "Society has to take action."

Twenty children and six adults were shot dead on Dec. 14 at the Sandy Hook Elementary School in Newtown, Conn. The children were all 6 and 7 years old.

Pinsky's claim said that the state Board of Education, Department of Education and Education Commissioner had failed to take appropriate steps to protect children from "foreseeable harm."

It said they had failed to provide a "safe school setting" or design "an effective student safety emergency response plan and protocol."

Pinsky said he was approached by the child's parents within a week of the shooting.

The shooting, which also left the gunman dead, has prompted extensive debate about gun control and the suggestion by the National Rifle Association that schools be patrolled by armed guards. Police have said the gunman killed his mother at their home in Newtown before going to the school.?

Honda CR-V 2.0 iVTEC EX review - Pocket-lint

Everyone loves to hate an SUV, don?t they? Yet, as our recent review of the VW Touareg attests, even those of us who hate the breed can?t help but be won over and see why they?re so popular with modern families, after a week behind the wheel.

And on the week of the supposed Mayan apocalypse, and as pre-Christmas Britain attempted to bail itself out of the latest bout of flooding, what could make you feel more warm, secure and invincible than a four-wheel drive SUV from a brand that?s got a reputation for making cars that just never, ever, go wrong?

So although a Honda CR-V might not top your list of sexy automotive forms of transport, the popularity of the previous model is testimony to the inherent usefulness of this car and its popularity with families. Given that it had just undergone a major redesign, we thought we?d put it through a review to find out if Honda had dared meddle with the previous model?s surefire success recipe.

Design

First impressions aren?t exactly promising. Sure, gone is the previous model?s ?had all its teeth knocked out? front grille graphic for a much more modern integrated lamp/grille design, but otherwise the CR-V seems to have taken a little bit of a step backward, becoming more boxy and like an estate car on stilts, while most of its rivals have moved towards a ?tall hatchback? crossover format, in an effort to eschew some of that hated SUV image.

It?s not bad per-se, and admittedly our press car?s white paintwork did it no favours, but compared to slinky SUVs such as Range Rover?s Evoque, Audi?s Q5 and even Nissan?s Qashqai, the CR-V?s appearance does little for us.

Open the door though, and things improve. Granted, if you?re used to Audi?s slush-moulded plastic-fest interiors, there are going to be a few too many hard (read cheap-feeling) surfaces for comfort. But the design layout is inherently logical and not without appeal.

What?s more, get behind the wheel, in the back or open the boot and you start to see Honda?s engineering heritage shining through, and understand how it makes for a simply better car.

From the driver?s seat, the scuttle - the point at which the bottom of the windscreen meets the top of the bonnet - is appreciably lower than any competitor, which is a benefit of super-compact powertrain beneath the bonnet. This means you can simply see more, including the end of the bonnet - a real rarity in cars these days - and one that makes the CR-V easier to park.

The gearstick is mounted on the dash, so you get an enormous centre console between driver and passenger that will swallow three 1-litre sized water bottles, and still also leaves space for a bin for keys, phones etc.

In the back, you?ve a flat floor and three proper seats ? including three-across isofix points for child seats, which gives the CR-V a massive advantage over its competitors, to those with larger families.

Tech

This is Honda?s strength, and the reason it's well worth considering. At 30-grand, give-or-take five hundred quid, this top of the line ?EX? model CR-V poses you a tricky question. In effect, your choice at this price, is to squeeze yourself (financially) into a bottom-of-the-range premium-badged car from BMW, Audi or Land/Range Rover or buy a ?bells and whistles? top of the range car for the same price, from a ?non-premium? brand like Honda.

So whereas most of the premium brands would ask you to pay extra for (deep breath) a panoramic roof; cruise control; parking sensors front and rear (including a camera); HD-based navigation; DAB radio; video/DVD/MP3/Bluetooth audio playback; heated, electrically adjustable leather seats; keyless access and an electric opening tailgate, this EX model CR-V nets you all of those as standard. In fact, the only option that came on our test car was the pearlescent white paint, which we?d suggest you forgo.

Perhaps better still, it all worked seamlessly and without any idiosyncrasies ? as you might expect from a Honda. We loved the attention to detail, like the fact the electrically opening tailgate was perfectly happy to be lifted and pulled closed manually as well as electrically. Normally, electric-powered tailgates freak out and freeze if you try to ?help? them. The fact that the rear seats fold via the tug of one lever inside the boot while doing a fun little dance: folding their headrests in, flipping up the squab and dropping the backrest in one single movement. This basically turns the CR-V into a van, one we squeezed an 8 ft Christmas tree into. Oh and there?s stop/start functionality and an economy button too, in an effort to reign-in any consumption excess.

Many of these are the kind of gadgets you might suggest you don?t need and which (pay attention other manufacturers), when done wrong, can irritate you day-to-day when you live with a car. But while on the CR-V they?re not executed with quite the premium, soft-touch, damped quality of an Audi, they do all work as expected, and tend to come in handy when you?ve an armful of shopping or child ? we can?t remember the last time a car soothed us and irritated us less than the CR-V.

On top of this, because it?s a Honda, you just know that none of it is going to break for the next fifteen years. It?s the kind of thing the company has built its reputation on, and which gives you ? the owner ? a reassuring, comforting sense ? especially if it?s going to be your family inside most of the time.

Driving

No one buys an SUV and expects it to drive like a sport cars, but the number of massive-wheel?ed, S-Line suspension?ed Audi SUVs out there suggests that people are more than happy to put up with a hard ride to make their SUV look ? and presumably drive ? more sportily.

The CR-V doesn?t really make any pretense at sporty, but its ride isn?t as cushioned as we?d like. It?s ability to deal with speed humps, pot holes and big road deflections is fine, but the secondary ride never truly settles down, jittering and letting you know everything that?s happening beneath you. Some will like this, as it could be construed as sportiness, but we?d trade it for a bit more comfort.

We highlight this area, as otherwise ? like in the tech area ? the CR-V is a really nice place to spend several hours , and is expertly judged for its market. If you?re not expecting sports car performance, it should suit you fine. The handling is safe and secure ? with the added back up of four-wheel drive when you need it. The gearshift is one of those beautifully precise jobs that Honda?s famous for, and it steers and handles true and straight ? it?s a good companion on a windy, rainy motorway for instance.

Our car came with Honda?s 2.0 VTEC petrol engine. In true Honda petrol-engine fashion, it likes revs to really get moving and given it?s pushing quite a lot of car around without the aid of a turbocharger, you?ll need to work it hard if you want to make decent progress. Most will therefore choose the diesel, which we?d suggest will suit the CR-V?s character better, and feel faster in most given driving situations.

We wanted to try the petrol though, as we continue to note that diesel costs more at the pumps and incurs a company car tax penalty. The diesel models also cost more to buy ? so unless you?re driving a lot of miles each year, the petrol may make more financial sense. If you?re not too fussed about the cost, we?d suggest you try both before buying, but don?t write off the petrol. In a mix of one third town driving and two-thirds high-speed motorway run, in our hands it returned a real-world 30mpg, whereas we?d expect the diesel to return 36-40 in the same conditions. Swings, roundabouts, etc.

REAL ESTATE: Equity home sales on the rise in November ... - blog

Posted on | December 28, 2012 | Comments

California?s pending home sales fell in November, as equity home sales across the state and the Inland region began to come out of the closet.

A report released Friday by the California Association of Realtors said pending home sales, forward-looking indicators of future home sales activity, fell nine-tenths of 1 percent from November 2011.

But the sputter the state?s largest real estate trade association blamed on seasonal factors was mixed with a more telling indicator of what?s to come in 2013: The share of equity sales is on the rise.

The pool of equity sales inched up to 64.9 percent from 63.4 percent in October, and represented a 14.7 percent gain from November 2011.

Equity home sales figures haven?t been this good since May 2008.

What?s more, the combined share of all distressed property sales fell to 35.1 percent in November, according to the C.A.R. report. The pool of distressed property sales stood at 49.8 percent in November 2011.

How did the hard-hit Inland region fare?

The percentage of single-family distressed home sales is still well above the state numbers, but the percentage of distressed home sales noted in November fell by the double-digits.

Realtors say they?re seeing more ?conventional? housing stock come into the marketplace, as homeowners with equity in their property see home prices began a slow recovery, rents began to rise and mortgage lending rates remain at near historic levels.

The pool of distressed homes in Riverside County fell 10 percent from November 2011 to 51 percent, down from 61 percent. In San Bernardino County, distressed property sales plunged 20 percentage points to 44 percent. In November 2011, some 64 percent of all single-family homes sold in San Bernardino County were in distress.

PFT: Ravens' Reed fine $55K for hit on Cruz

Lomas Brown LionsGetty Images

A funny thing happened in the course of Lomas Brown trying to walk back his claim last week that he once intentionally missed a block in order to get his teammate Scott Mitchell injured: Brown says he has discovered that his memory is wrong, and the play on which he purposely missed a block is different than the play on which Mitchell suffered a season-ending injury.

That?s what Brown told Gregg Doyel of CBS: According to Brown, the former Lions left tackle who is now an ESPN commentator, ESPN went through its archives and found the play that ended Mitchell?s season, and it wasn?t the same play that Brown remembered.

After Brown?s boast about purposely getting Mitchell hurt became a hot topic in the NFL this week, someone posted a video on YouTube that appears to show the play that got Mitchell hurt in a loss to the Packers. That play does show Brown lining up at left tackle and turning to the inside, leaving Packers right defensive end Sean Jones alone to rush to the outside and get a free shot at Mitchell. But as the New York Times noted, there?s really no way to know whether Brown was supposed to block Jones on that play and intentionally let him go, or whether the Lions? pass protection on that play called for Brown to block to the inside.

Brown?s memory of the 1994 game is faulty. He described the Lions as being down 24-3 at the time he missed his block, but the score of that game was never 24-3. Based on the YouTube video, it appears that the score was actually 10-0 when Mitchell was hurt. And Brown?s description of the play suggests that he initially engaged Jones but then let him go, while the video shows Brown turning inside at the snap and never going near Jones.

In any event, whether Mitchell?s injury actually happened on a play on which Brown intentionally missed a block isn?t particularly important. Either (1) Brown tried to injure a teammate and succeeded, or (2) Brown tried to injure a teammate and failed but happened to get his wish because the teammate got injured on another play in the same game. Brown initially claimed option 1 but now claims option 2. Neither of those options reflects well on Brown.

The third option is that Brown fabricated a story about intentionally injuring a teammate because he thought that would be a swell way to get attention. That sounds ridiculous, but considering that Brown makes his living by appearing on ESPN First Take, a show that encourages its panelists to seek attention by making outrageous statements, it?s plausible.

If that?s what happened, and Brown has now discovered that the attention he generated is unwanted, claiming that he wasn?t actually responsible for Mitchell?s injury might be Brown?s way of attempting to minimize the damage to his reputation. But whatever Brown may say now, his reputation has been permanently tarnished.
