Djokovic makes quick work of Benneteau

NEW YORK (AP) ? Novak Djokovic woke up early and got things over with in a hurry Sunday at the U.S. Open.

Serving as the warm-up act for Andy Roddick in Arthur Ashe Stadium, the defending champion completed his second straight match without facing a break point and defeated No. 31 Julien Benneteau 6-3, 6-2, 6-2 to advance to the fourth round for the sixth straight year.

Djokovic needed only 1 hour, 37 minutes to clear out of the stadium, where Roddick was the headliner on Sunday's schedule.

Last week, the 2003 champion announced he would retire after the U.S. Open. He followed Djokovic onto the court for a third-round match against Italy's Fabio Fognini.

Roddick could only hope he'd be in for as easy a time as Djokovic had. The No. 2 seed from Serbia faced a break point in the opening game of the tournament, against Paolo Lorenzi. Djokovic lost that point and hasn't faced one since.

"Obviously, the serve is something I've wanted to improve the last 15 months or so," Djokovic said. "I wanted to get more free points on the first serve. Today, it was working very well."

Djokovic finished with 13 aces with a top service speed of 128 mph. He said he's not so used to early wake-up calls at the season's last major, where he has made the final the last two years and is more used to playing in prime time. To make sure he wouldn't be late for the third-round match, he shaved the night before and had a bit of stubble jutting from his chin by the early afternoon.

"I'm not always the morning person, to be honest," Djokovic said. "You try to go to bed early and try to wake up early and get your body moving obviously. I wanted to start very sharp from the first point, and I've done that."

Djokovic's entire match took only 23 minutes longer than the first set between No. 4 David Ferrer and 2001 champion Lleyton Hewitt in Armstrong Stadium. Ferrer saved five set points in the first-set tiebreaker then went on to a 7-6 (9), 4-6, 6-3, 6-0 victory to advance to the fourth round for the 10th straight Grand Slam tournament.

Playing later Sunday were No. 3 Maria Sharapova, who has an evening match against No. 19 Nadia Petrova, and 18-year-old Laura Robson of Britain, who had an evening match against defending champion Samantah Stosur.

If Christopher Vaughn did shoot his family in cold blood, his motive for doing so became clear to jurors on Friday as they read in detail about the Oswego man?s plans to ditch society and his life of obligations for a life in the Canadian wilderness with a man he met online.

?I?m wondering what it says when the biggest thing I?ll miss is my Jeep,? Vaughn, using the pseudonym ?Flint,? wrote to 31-year-old Stephen Willott of Canada. The two met online in October 2006 on a website where they bonded over their mutual desire to leave civilization behind. For Vaughn, that included a steady job, a wife and three kids.

In the series of emails, which Willott read to jurors on Friday, Vaughn mentions a wife, but no children. Instead, the two spent nearly eight months making plans for their departure, which they planned for spring 2008.

As each day passed, Vaughn seemed to obsess more and more about leaving, unable to focus on much else.

?I don?t think I can wait until next year,? Vaughn wrote as he planned a May 2007 trip to Canada to scout the terrain. ?The trip may change the timeline.?

Within a month of his return to the United States from that trip, Vaughn?s wife and three children were found shot to death in the family?s SUV.

Abby, 12, Cassandra, 11, and Blake, 8, were found shot along with Kimberly Vaughn on June 14, 2007, in the family?s red SUV. It was found parked on a desolate frontage road off Interstate 55 in Channahon, where Vaughn said he had pulled over on the family?s way to a Springfield water park.

Defense attorneys maintain it was a suicidal Kimberly Vaughn who shot her husband, causing superficial wounds on his wrist and leg, before killing her children and then herself. But prosecutors claim Vaughn shot his family so he could live life in the wilderness without obligations.

The emails read Friday shed light on that motive, but not the actual deaths of his family. At one point, Vaughn mentions faking his own death so his wife would get his life insurance money and be taken care of after he left.

?Without following through with the plan, I can?t go with a clear conscience,? Vaughn wrote. But upon his return from his scouting trip, it appeared that the following spring couldn?t come soon enough.

?If I had stayed much longer, I wouldn?t have come back,? Vaughn wrote on May 14.

On Friday, jurors saw pictures Vaughn had taken during his Yukon trip. From his seat at the defense table, Vaughn stared longingly at the screen as each photo was displayed. If convicted, that could be the closest the wilderness lover ever comes to the trees again.

The lengthy email exchanges took place almost daily until Willott suddenly quit hearing from Vaughn in June 2007. Prior to that, they discussed writing a book about their adventures, or videotaping themselves like other survivalists have done for television.

Willott said he believes Vaughn was absolutely going to disappear for good, and that for Vaughn it was no ?camping trip.?

He also lamented his failing marriage.

It was ?really just a few years ago when I woke up and realized it wasn?t going to work,? Vaughn wrote the day after Valentine?s Day 2007. He said Kimberly would start talking about things she wanted to do in the upcoming years and ?I just shrug it off.?

?You shouldn?t do something because everyone else does,? Vaughn wrote. ?I started down that path, but unlike most people, I realize I have a choice.?

In one email, Vaughn mentions a woman he met at a club who might be interested in coming along for the ?long walk,? but he doubted her commitment to being able to do so.

?Feel free to talk to some sense into me, man, because I am starting to think that it wouldn?t be too bad bringing her along,? Vaughn wrote.

At the conclusion of Vaughn and Willott?s first face-to-face meeting Friday, the former friends gave each other a slight smile. Willott told prosecutors Vaughn was a good listener, enjoyed a good laugh and was someone he considered a friend. Lawyer: Ex-SEAL did seek advice about bin Laden book

A retired Navy SEAL could face legal action for his upcoming book about the raid that killed Osama bin Laden. The Pentagon is threatening to file criminal charges against the man who wrote the book, "No Easy Day," under a pseudonym. NBC's Jim Miklaszewski reports.

Updated at 2 p.m. ET --?The lawyer for "Mark Owen" -- the pen name of the former Navy SEAL who wrote "No Easy Day," a book describing the Osama bin Laden raid -- on Friday said that Owen did, indeed, seek legal advice before publishing the book and he disputed other claims made by Pentagon.

"Mr. Owen sought legal advice about his responsibilities before agreeing to publish his book and scrupulously reviewed the work to ensure that it did not disclose any material that would breach his agreements or put his former comrades at risk," Robert Luskin wrote in a letter addressed to Pentagon General Counsel Jeh Johnson. "He remains confident that he has faithfully fulfilled his duty."

Furthermore, Luskin said a non-disclosure agreement Owen signed -- which the Pentagon claimed he was "in material breach" of -- doesn't require Owen to submit his book for review. "As you are well aware, the Classified Information Non-Disclosure Agreement, which you attached in your letter, invites, but by no means requires Mr. Owen to submit materials for pre-publication review," the letter said.


A Pentagon spokesperson on Friday said it is unclear if the book actually contains damaging classified information. "I'm not going to say whether the book has classified information in it," spokesperson George Little told reporters.

On Thursday, Johnson?said in a letter?that?Owen is in violation of the non-disclosure agreement.?

The letter,?sent via the attorney at Penguin Putnam publishing, explained that Owen signed two separate non-disclosure agreements on Jan. 24, 2007, and that he has an obligation to "never divulge" classified information.

"This commitment remains in force even after you left the active duty Navy," Johnson wrote.

Pentagon's top lawyers reminded the ex-Navy SEAL who authored the tell-all on the bin Laden raid that they are considering legal action against him for publishing "classified" information. NBC's Jim Miklaszewski reports.

He also signed a "Sensitive Compartmented Information Debriefing Memorandum" when he left the Navy around April 20, 2012, according to the letter.

"The Department of Defense has obtained and reviewed an advanced copy of the book ... In the judgment of the Department of Defense, you are in material breach and violation of the non-disclosure agreements you signed," the letter said.?"Further public dissemination of your book will aggravate your breach and violation of your agreements.

"The Department is considering pursuing against you, and all those acting in concert with you, all remedies legally available to us in light of this situation."

A senior Defense official on Thursday said, "There has to be consequences" for someone who violates the non-disclosure agreements prohibiting the release of classified information.

The official also suggested that by revealing "tactics, techniques and procedures" employed by the Navy SEALs during the raid, "it could put other operators at risk and future operations in jeopardy."

"No Easy Day," written by a former Navy SEAL who helped take down Osama bin Laden, claims the al-Qaida leader did not defend himself during the raid. The book will become available on Sept. 4, earlier than the anticipated Sept. 11 release date. NBC's Jim Miklaszewski reports.

Plan to rework L.A. trash hauling moves to City Council

A controversial plan to carve the city of Los Angeles into 11 new and exclusive commercial trash hauling franchise areas was approved unanimously by two City Council committees Wednesday.

The matter now goes to the full council for a vote despite objections from some business interests and apartment owners, as well as the city's top budget guru, Chief Administrative Officer Miguel Santana.

The plan is backed by a powerful coalition of labor and environmental groups, who say it will boost recycling, reduce truck traffic, and improve working conditions in a hazardous industry. The city's sanitation department also backs the plan.

Hillary Gordon of the Sierra Club was one of a number of environmentalists who spoke during a 41/2- hour hearing and hailed the franchise plan as "absolutely better for the environment."

Maria Elena Durazo, who heads the Los Angeles County Federation of Labor, said the exclusive system would also be better for workers. "We have health and safety laws now, but they are abused daily by the waste and recycling industry," she said.

Many trash companies and business interests spoke against exclusive franchises, saying the city could achieve the same recycling and environmental goals while maintaining a more competitive trash hauling market. Some also have asserted that exclusive franchises are a gambit by organized labor to represent more refuse workers.

The city picks up trash from single-family homes and small apartment buildings. But privatized trash hauling for large apartment buildings, factories and businesses involves about 150 companies whose trucks crisscross the city. The firms collect about $224 million a year in Los Angeles.

"Competition is what drives the solid waste industry in Los Angeles," said Ron Saldana, head of the Los Angeles County Disposal Assn. "Kill it and you will be dependent on moving forward ? with a new, inefficient bureaucracy."

Speakers on both sides of the issue said the current commercial trash system needs improvement.

Santana, the city's CAO, has backed a retooled, non-exclusive plan, saying it could produce similar benefits and provide the cash-strapped city up to $30 million as soon as next year.

But at a joint session, six council members on the ad hoc waste and environmental committees disagreed, after hearing lengthy comments on the trash-hauling needs of movie studios, practices of other cities and how the city can meet a 2025 goal of recycling up to 90% of its waste.

Councilman Paul Koretz said creating better regulated, exclusive franchise territories would set a standard that the rest of the country can emulate. Council members Richard Alarcon, Jose Huizar, Paul Krekorian and Dennis Zine agreed.

Council member Tony Cardenas asked for a "minority report" suggesting the full council also consider a non-exclusive franchise system. It is "disingenuous to approve an exclusive franchise model on the false premise that it is the only way to achieve high environmental standards," he said in a statement.
